NO PURCHASE IS NECESSARY TO ENTER OR WIN. Registration for the SportsTime Ohio Shell Fifth Inning Gas Giveaway ("Giveaway") begins at 9:00am Eastern Daylight Time ("EDT") on June 23, 2008 and ends at 11:00PM Eastern Daylight Time ("EDT") on July 25, 2008 ("Registration Period"). The Giveaway begins at 8:00pm EDT July 1, 2008 and ends at 5:00pm EDT on July 31, 2008 ("Giveaway Period"). During the Registration Period, go to
www.STOHD.com to enter into the Giveaway for a chance to win one (1) free SHELL® Gas Card ("Prize").
HOW TO ENTER: Fill out the entry form on the SportsTime Ohio website by clicking on the link http://www.sportstimeohio.com/...at www.STOHD.com. No other method of entry will be accepted. Limit one (1) entry per person (each entrant, a "Participant"). All eligible entries will be entered for a chance to win. Entries become the property of the Sponsors, as hereinafter defined, and will not be returned. VOID WHERE PROHIBITED BY LAW.ELIGIBILITY: All Federal, State and local laws and regulations apply. Giveaway is open to U.S. residents eighteen (18) years and older. Employees of SportsTime Ohio and Shell (the "Sponsors") and their respective parent companies, sales representatives, distributors, directors, officers, governors, owners, subsidiaries, affiliates, related companies, and advertising and promotion agencies and the immediate families and/or household members of each of the above are not eligible to enter.
DRAWINGS: Prior to the beginning of each Cleveland Indians baseball game televised on SportsTime Ohio during the Giveaway Period, an employee of SportsTime Ohio (a Sponsor and the conductor of this Giveaway), will randomly select ten (10) names from the eligible entries received ("Selected Participants"). The Selected Participants will have the chance to win the Prize during the 5th inning of that particular Cleveland Indians baseball game televised on SportsTime Ohio. The name(s) of the Selected Participant(s) may be announced during the broadcast of the Cleveland Indians baseball game airing on SportsTime Ohio as the Selected Participant who has a chance to win one (1) Prize. Selections will be conducted by SportsTime Ohio, whose decisions are final and binding in all matters relating to this Giveaway. Odds of winning depend on the total number of eligible entries received. Those Selected Participants who did not win a Prize may be reentered into the Giveaway by Sponsor for a chance to win a Prize at a future Cleveland Indians baseball game televised by SportsTime Ohio during the Giveaway Period.
PRIZES: One (1)Prize will be awarded to a Selected Participant for an official hit by a Cleveland Indians baseball player during the 5th inning of the particular SportsTime Ohio televised Cleveland Indians baseball game during the Giveaway Period ("Winner"). The Prize will be based on the type of hit (as indicated below) by a Cleveland Indians baseball player during the 5th inning of an official game and must be recognized as an official hit by the official scorer present at the Cleveland Indians baseball game and the applicable Major League Baseball league office. Each of Selected Participant can win only one (1) Prize. Once a Selected Participant wins a Prize, a new Selected Participant will be eligible to win a Prize if a Cleveland Indians player has another hit in the 5th Inning of the particular SportsTime Ohio televised Cleveland Indians baseball game. At the conclusion of the 5th Inning of a particular SportsTime Ohio televised Cleveland Indians baseball, all Selected Participants that did not win a Prize may be reentered into the Giveaway for a chance to win in the future. Winners will be notified by phone or email within 48 hours of winning. In the event the Winner(s) cannot be verified within 36 hours from notification, declines the Prize, or does not fully comply with these official rules, then an alternate Winner(s) may be selected at random from the remaining eligible entries.
Each Winner will receive one (1) Shell® Gas Card ("Prize") with a value subject to the following:
a. Cleveland Indians player's hit of the 5th inning = Single = $100 Shell® Gas Card;
b. Cleveland Indians player's hit of the 5th inning = Double = $200 Shell® Gas Card;
c. Cleveland Indians player's hit of the 5th inning = Triple = $300 Shell® Gas Card;
d. Cleveland Indians player's hit of the 5th inning = Home Run = $500 Shell® Gas CardThe Approximate Retail Value ("ARV") of the Prize is the face value of the particular gas card awarded.
PRIZE ACCEPTANCE: Limit one (1) Prize per household during the Giveaway Period. Prize is not transferable. No substitution or cash redemption allowed except by Sponsors, who may substitute the Prize for a Prize of equal or greater value if advertised Prize becomes unavailable. Winner is responsible for all costs and coordination associated with shipment or pick up of Prize. If applicable, Winner will be required to complete, sign, and return W-9 Form, an Affidavit of Eligibility/Prize Acceptance/Liability, and a Publicity Release Form (except where prohibited by law) immediately following notification and receipt, or Prize will be forfeited and awarded to an alternate winner. By accepting Prize, Winner consents to use of his/her name and likeness for broadcast and advertising purposes worldwide by Sponsors and each of their respective parents, subsidiaries, and affiliates, without limitation and without additional authorization, remuneration, and compensation, except where prohibited by law

GENERAL: The Giveaway is subject to all applicable Federal, State and local laws and regulations. By participating, Participants accept and agree (a) to be bound by these Official Rules, including eligibility requirements; (b) that the decisions of the Sponsors are final on all matters relating to the Giveaway; © to waive any right to claim ambiguity in the Giveaway or these official rules; (d) to Sponsors' use of the Participant's/Selected Participant's/Winner's information submitted in connection with the Giveaway. Any depiction of the Prize is for illustrative purposes only. Sponsor may prohibit a Participant from participating in the Giveaway and/or of winning the Prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, hacking, deception, or other unfair playing practices (including quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsors representatives. Entrants who violate these official rules or engage in any conduct that is detrimental or unfair to Sponsors, the Giveaway Parties, or any other entrants (in each case as determined in Sponsors' sole discretion) are subject to disqualification from entry into the Giveaway. Any person attempting to defraud or tamper with the Giveaway will be prosecuted and will not be eligible for the Prize. If for any reason this Giveaway is not permitted or capable of running as planned, including, but not limited to, tampering, authorized or unauthorized intervention, fraud, or any other causes beyond the reasonable control of Sponsors which corrupts or affects the administration, legality, security, fairness, integrity or proper conduct of the promotion, then Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the Giveaway.
WAIVER OF LIABILITY: The Sponsors and Giveaway Parties and their respective employees, licensees, representatives and agents make no warranties, express or implied, relative to the use or enjoyment of the Prize or portions thereof, including without limitations, its quality, merchantability or fitness for a particular purpose. By entering the Giveaway, each Participant agrees to hold harmless and fully release the Sponsors and their respective employees, licensees, representatives and agents from any and all liability for any injuries, losses, death, or damages of any kind caused by the participation in the Giveaway or resulting from the acceptance, possession, quality, use or misuse of the Prize, or any portion of the Prize or travel related to the receipt of the Prize, including, but not limited to (a) unauthorized intervention in the Giveaway, (b) technical error related to computers, servers, or providers, © printing, typographical or human errors, (d) errors in administration of the Giveaway, advertising of the giveaway, selection and announcement of the Selected Participants and/or Winner, distribution of the Prize, or the processing of entries, (e) any cancellation or modification of the Giveaway due to weather or circumstances beyond Sponsor's control , or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Participant's participation in the Giveaway or receipt of the Prize. Participant further agrees that in any cause of action, Sponsor's liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall Sponsor be liable for attorney's fees. Participant waives the right to claim any additional damages whatsoever, including, but not limited to punitive, consequential, direct, or indirect damages. All federal, state and local laws and regulations apply. In the event the Giveaway is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Contest, or to disqualify any Participants residing in the affected geographic area. Sponsor also reserves the right to halt, modify, reschedule or suspend the Contest at any time before or during the Giveaway due to situations beyond the control of the Sponsors such as work stoppages, acts of God (including but not limited to the cancellation or postponement of the baseball game due to weather), acts of terrorism, civil disturbances, etc. Sponsor also reserves the right to reschedule or cancel the Giveaway in part or in its entirety for any other reason in Sponsor's sole discretion. This Giveaway and these Official Rules will be governed by the laws of the State of Ohio. Any court of competent jurisdiction sitting within the State of Ohio, Cuyahoga County will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Giveaway or these Official Rules.
